Before using the services provided by Pacem Holding B.V. ("Legacy"), a company registered in the Netherlands, please carefully read these Terms of Use. These terms and conditions are legally binding and outline your use (as "User(s)") of the website at www.golegacy.app and the Legacy mobile apps (collectively referred to as the "Platform"), as well as the services, features, content, applications, or widgets offered by Legacy (referred to as the "Service"). These Terms of Use are available for download and printing at golegacy.app.
Acceptance of Terms
By using the Service, including but not limited to visiting or browsing the Platform, you agree to be bound by these Terms of Use. The Terms of Use include Legacy's Privacy Policy and all other operating rules, policies, and procedures that may be published on the Platform from time to time, all of which are incorporated by reference and subject to change by Legacy. Any amendment of these Terms of Use will be announced at least one month before it takes effect. If a User does not agree to an amendment, they have the right to terminate the agreement before the amendment takes effect. In addition, certain services offered through the Service may have their own additional terms and conditions specified by Legacy, which are incorporated into these Terms of Use by reference.
Access
Legacy may provide the Services, as described on the Platform and selected by the User, solely for the User's personal non-commercial use, subject to these Terms of Use.
Registration and Eligibility
You have the option to browse the Platform and view the Content without registering. However, to use certain aspects of the Service, you must register and become a User with Legacy. By registering, you represent and warrant that you have provided Legacy with accurate and complete registration information, including a username, email address, and password, and that you will keep your registration information accurate and up-to-date. If you fail to do so, it will be considered a breach of these Terms of Use, which may result in the immediate termination of your account.
You are not permitted to create an account for anyone other than yourself without their permission. Additionally, you are not allowed to use a username that belongs to someone else with the intention of impersonating that person, or use a username that is offensive, vulgar, obscene, or otherwise unlawful. Legacy reserves the right to refuse registration of a username or cancel an account in its sole discretion.
As a User, you are responsible for any activity that occurs on your account and for maintaining the confidentiality of your Legacy password. You should never use another user's account without their express permission, and you must notify Legacy in writing of any unauthorized use of your account or other account-related security breach of which you are aware.
You represent and warrant that you are of legal age to form a binding contract if you are an individual, or that you are authorized to enter into and bind an entity to these Terms of Use and register for the Service if you are registering on behalf of an entity. The Service is not available to individuals under the age of 16. Legacy reserves the right to refuse to offer the Service to any person or entity and to change its eligibility criteria at any time. If using the Service or agreeing to these Terms of Use is prohibited by any laws, rules, or regulations applicable to you, you agree not to use or access the Platform or Services in any way.
You understand that you are responsible for any charges associated with sending communications via your device, and you acknowledge that you have the right to communicate with your contacts via the Service.
Your Content
The term "Content" in these Terms of Use includes location information, videos, audio clips, comments, data, text, photographs, software, scripts, graphics, photo albums, and interactive features provided by Legacy on or through the Service. The sole intellectual property of the person who posts or transmits Content, whether publicly posted or privately transmitted, must be respected. Legacy cannot guarantee the authenticity of any Content or data users may provide about themselves. Users accessing Content using the Service are solely responsible for any damage or loss resulting from it.
Users retain intellectual property rights related to their Content available through the Service. By making the Content available through the Service, they automatically grant Legacy an unlimited, worldwide, sublicensable, and transferable license to use all or part of the Content for the purpose of providing the Service and/or Legacy's business activities, within the limits of the privacy settings chosen for the content. Legacy may use such Content publicly or privately, as it sees fit, including displaying it, reformatting it, creating derivative works from it, promoting it, and distributing it.
Users also grant each other authorized Users a non-exclusive license to access and use the Content in connection with their use of the Platform and Service. Users are responsible for their Content and ensure that they have all necessary rights to grant the licenses in accordance with these Terms of Use without infringing on any third-party rights. Users also indemnify Legacy against any and all third-party claims based on any alleged infringement of such third-party rights concerning the Content.
When users delete their Content, it will be removed from the Service, but it may persist in backup copies for a reasonable period or may remain with Users who have previously accessed and downloaded the Content.
Rules and Conduct
By using the Service, you agree not to use it for any purpose that violates these Terms of Use. You are responsible for all of your activities in connection with the Service. Additionally, you must comply with all applicable national and international laws and regulations, as well as any advertising, marketing, privacy, or other self-regulatory codes applicable to your industry if you represent a business.
Termination
Legacy may terminate your access to all or any part of the Service at any time, with or without cause, with or without notice, effective immediately, which may result in the forfeiture and destruction of all information associated with your membership. If you wish to terminate your account, you may do so by following the instructions on the Platform. Any fees paid hereunder are non-refundable. All provisions of these Terms of Use which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Governing Law
These Terms of Use and any disputes or claims arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Netherlands. All disputes or claims arising out of or relating to these Terms of Use shall be subject to the exclusive jurisdiction of the Court in Amsterdam to which the Parties irrevocably submit.
